Talking Points

The Problem ā–¼
  • 73% of children encounter online pornography before age 18 (Common Sense Media, 2024)
  • Average age of first exposure: 12 years old
  • Currently, most states have zero age verification requirements for adult websites
  • Exposure is linked to anxiety, depression, distorted relationship expectations, and in some cases addiction
  • Adolescent brains are uniquely vulnerable — early exposure affects neural development during critical periods
The Solution ā–¼
  • Age verification technology exists today that is privacy-preserving and does not store personal data
  • Device-based verification, third-party age estimation, and digital ID solutions are all viable
  • California's Protection of Minors from Online Pornography Act provides a strong legislative model
  • The law places the burden on websites, not parents or children
The Legal Precedent ā–¼
  • The U.S. Supreme Court ruled 6–3 in Free Speech Coalition v. Paxton (2025) that state age verification laws are constitutional
  • 22 states have already enacted age verification legislation
  • 3 states have laws currently being challenged in court (AR, MS, OH)
  • 6 states have legislation pending (HI, IA, MI, MN, WA, WV)
  • This is not a First Amendment issue — the Court has affirmed that protecting minors is a compelling state interest
Response to Objections ā–¼
  • "Parents should handle this." — Parents cannot monitor every device, every Wi-Fi network, every friend's house. This requires systemic protection.
  • "It violates free speech." — The Supreme Court has ruled otherwise. Age verification is not censorship — adults retain full access.
  • "It won't work / VPNs exist." — No law is 100% effective, but states with age verification have seen significant traffic drops to adult sites. Seatbelts aren't perfect either — we still require them.
  • "It's a privacy risk." — Modern verification methods confirm age without storing identity. No data is retained.
